What is the length of teachers' vacation in 2024: what does the law say?

According to the law of Ukraine on vacations, teachers have the right to an annual vacation of up to 56 calendar days (Article 6). However, due to Russian military aggression, the document has undergone certain changes.

Because of the war, an additional law appeared on the organization of labor relations under martial law. According to this document, the employer has the right to limit and reduce the duration of annual leave to 24 calendar days.

This is the right of the employer, but he is not obliged to do so.

That is, the duration of the vacation is determined by the employer — head of the educational institution. But to reduce vacation, a justification is necessary, due to objective reasons that push the manager to reduce the duration of vacation. If there are no such conditions, then teachers have the right to annual leave of total duration, i.e. up to 56 calendar days.

Even if this year the teacher received a vacation of not 56, but 24 calendar days, you should not be upset. The law provides that a teacher or other employee whose vacation lasts more than 24 calendar days will be able to use these days after the termination or lifting of martial law.

Can a teacher be denied leave

Part 2 of Article 12 of the law states that the employer may refuse to provide an employee with any leave, except for leave associated with pregnancy, childbirth, child care and reaching the age of three, if the person is involved in work at critical infrastructure facilities.

In sector 19 of Cabinet of Ministers Resolution No. 1109 it is stated that critical infrastructure facilities include institutions engaged in scientific research and development. In particular, this is the research infrastructure of scientific institutions and higher education institutions.

If we are talking about a school, then they cannot refuse to grant leave to a teacher. If the employer nevertheless decides to provide annual leave to a teacher lasting not 56, but 24 days, then he will still have to compensate for the other part of the leave, but after the war.
