Martial law and general mobilization have been extended in Ukraine until February 19th. At the same time, the law provides for the conditions under which the military has the right to be dismissed from service.

Under what conditions can they be released from military service during mobilization and can a military man be called up again, lawyer Marina Bekalo explained. More tells 24 channels.

The lawyer noted that those transferred to the reserve have the right to a deferment within 6 months from the date of dismissal, however, only during partial mobilization. At the same time, during the general period, this rule does not apply.

The military cannot be mobilized if the reason for the delay is the paragraphs of Article 23 of the Law of Ukraine “On mobilization training and mobilization”.

Who has the right to be discharged from military service during general mobilization

  • Reserved for the period of mobilization and wartime for state authorities, other state bodies, local governments, as well as for enterprises, institutions and organizations in the manner prescribed by the Cabinet;
  • recognized as persons with disabilities or, in accordance with the conclusion of the military medical commission, temporarily unfit for military service for health reasons for up to six months (with subsequent passage of the military medical commission);
  • women and men who are supported by there are three or more children under the age of 18, or raising minors on their own;
  • women and men, guardians, trustees, foster parents, parent-educators raising a child with a disability under the age of 18;
  • women and men who support an adult child who is a person with a disability of group I or II, or orphans or minors deprived of parental care;
  • are constantly caring for a sick wife (husband), child, as well as their parents or a wife (spouse) who, according to the conclusion of a medical and social expert commission or a medical advisory commission of a healthcare institution, need constant care;
  • having a wife (spouse) from among persons with disabilities and/or one of their parents or parents of a spouse (spouse) from among persons with disabilities of group I or II;
  • employees of military command and control bodies (government bodies), military units (divisions), enterprises, institutions and organizations of the Ministry of Defense, Armed Forces of Ukraine, SBU , the National Guard, the State Border Service, the National Police, the Bureau of Economic Security, NABU, DBR, etc.;
  • other persons liable for military service or certain categories of citizens in cases provided for by law.
