The Rada increased the threshold for criminalizing petty theft tenfold

On July 18, parliament members supported draft law 11068 to amend the Code of Administrative Offenses.

Thus, in Ukraine the threshold for criminalization of petty theft has been increased tenfold.

Bill 11068 — which provides

According to the draft, which was submitted to the Verkhovna Rada on March 8, 2024,  theft of property worth up to 3,028 UAH will be considered an administrative offense.

Before the law comes into force, theft is considered petty if the value of the stolen property at the time of the crime does not exceed 0.2 of the tax-free minimum income of citizens — 302.8 UAH

However, under martial law, theft is automatically qualified under Part 4. Art. 185 of the Criminal Code and is punishable by imprisonment for a term of five to eight years.

The authors of the bill give examples when a person is sentenced to five years probation for a bottle of alcohol worth 596 UAH.

The initiators of changes to the Code of Administrative Offenses consider such punishment to be disproportionate to the violation, therefore they called on people’s deputies to raise the threshold for initiating criminal proceedings.
