The Verkhovna Rada at a meeting on July 8 simplified the procedure for the departure of children from Ukraine. Now each parent can give permission for a child under 16 to travel abroad temporarily in the Diya app. He stated that they had determined a clear list of grounds when one parent can take a child abroad without the consent of the other parent. We are talking about children under 16 years old.

The grounds for taking a child out without the permission of the second parent

It is possible to take one of the parents of a child abroad without permission, under certain circumstances. In particular, people's deputies defined a clear list of grounds:

  • if the second parent has died or the court decision declaring him dead has come into force;
  • the court decision has come into force to deprive the parental rights of the second parent. Or if he is declared missing or incapacitated.
  • in the event of the death of the second parent or the entry into force of a court decision declaring him dead;
  • if the child or second parent is a foreigner or stateless person.
  • if the child is leaving accompanied by a single mother;
  • if the departure is accompanied by one of the parents, the place of residence of the child with whom is determined by a court decision or confirmed by the conclusion of the guardianship authorities. True, then the child’s departure is allowed for a period of not more than one month.
  • if the second parent has alimony debt, the amount of which exceeds the amount of the corresponding payments for 3 months;
  • if there is a court decision on permission to temporarily leave Ukraine for a child without the consent of the other parent.
