Poland cancels the lawsuit against Russia in the ECHR/Collage 24 Channel

The Polish government has decided to cancel the lawsuit against Russia in the European Court of Human Rights. It concerned the plane crash in which Polish President Lech Kaczynski died.

The corresponding information was reported by Polish Foreign Minister Radoslaw Sikorski on January 18. He explained the reason for this decision.

What is known about Poland's decision not to file a lawsuit against Russia

Filing an application that does not even have a theoretical chance of success exposes the state and taxpayers to unjustified expenses, the Polish minister said.

Before this, on January 15, 2024, the new Cabinet of Ministers of Poland dissolved the government commission that re-investigated the Smolensk plane crash. During the tragedy in 2010, then-President Lech Kaczynski, his wife and about 90 representatives of the Polish political, military, and religious elite died.

“A special group will be created in the near future, which will analyze all aspects of the activities of the liquidated commission,” the Polish Ministry of Defense assured.

Deputy Minister of Defense Cezary Tomczyk said that the liquidation of the commission means the end of spending hundreds of millions of zlotys on activities, which “has nothing to do with finding out the causes of the Smolensk disaster.”

The commission was supposed to investigate Russia's likely involvement in the disaster< /h2>

In 2016, Poland created a commission that was supposed to investigate Russia's likely involvement in the disaster, although it never provided evidence. At that time, the Polish Ministry of Defense was headed by Antoni Macierewicz, who in 2016 stated that the cause of the tragedy could have been a terrorist attack, already in October 2017 said that one of the plane’s flight recorders “recorded the moment of the explosion.”

Two preliminary reports by Polish and Russian aviation accident experts wrote that they found no evidence of foul play and the crash was the result of human error. However, the Polish people and the main representatives of the Law and Justice Party (PiS) questioned the results of this investigation.

Briefly about Smolenskaya plane crash

  • On April 10, 2010, a Russian-made Polish plane Tu-154M crashed near the Russian city of Smolensk. There were 96 people on board, including Polish President Lech Kaczynski and First Lady Maria.
  • Also there were the country's military, political and religious elite: head of the National Bank Slawomir Skrzypek, chief of the general staff of the Polish Army Frantisek Gongora, air force commander Andrzej Blasik, head of the National Security Bureau Alexander Szczyglo, head of the presidential administration Wladyslaw Stasiak, vice-speaker of the Sejm Jerzy, minister of foreign affairs Andrzej Kremer, the President of the Republic in Exile Ryszard Kocharowski, the head of the Institute of National Remembrance Janusz Kurtika and a number of other officials. were destroyed by order of Moscow in 1940.
  • Unfortunately, all 88 passengers and 8 crew members on board the plane were killed. As for the causes of the tragedy, the answer should have been given by the Interstate Aviation Committee (IAC), which was under significant influence of the Russian authorities. They quickly came to the conclusion that “the Tu-154M plane crashed due to an error by the Polish crew.”
  • The Polish side did not have access to a significant amount of materials, so they formally agreed with MAC results. However, the twin brother of the deceased president, Jaroslaw Kaczynski, and many other famous people of Poland stated that they do not recognize the results of the investigation and consider them unsubstantiated.
  • In 2022, the District Court of Warsaw arrested the Russian in absentia air traffic controller, who on the day of the crash controlled flights at the Russian Smolensk airport. The representative of the National Prosecutor's Office of Poland, Lukasz Lapczynski, said that before this, prosecutors suggested that the suspects, by deliberately allowing the plane to descend, foresaw the disaster and agreed to it.
