Russians continue to mobilize Ukrainians in the temporarily occupied territories. Basically, this is done by force.

Those who do not want to fight for the Russians and kill Ukrainians immediately surrender. But that they have to prove that they did not commit war crimes. Human rights activist Pavel Lysyansky told Channel 24 about this.

According to Lisyansky, the Russians forcibly mobilized more than 100,000 Ukrainians in the temporarily occupied territories. “It cannot be said that everyone was sent to the front. There are many functions there, in particular, logistics, strengthening the defense line, etc.,” he explained.

Legislation should work

Lisyansky spoke about his client, a teacher of computer science, who was mobilized on February 23. “He was taken away under escort and sent to a military meeting. Subsequently, he and others ended up in Kharkov, Ilovaisk, they dug trenches, and as soon as they saw the Armed Forces of Ukraine, they immediately surrendered,” the human rights activist said.

The men are charged with treason and terrorism. They face 13 to 15 years. According to Lysyansky, this is unfair.

A collaborator from the Kharkiv region was given a 5-year suspended sentence, with a 4-year trial period. The SBU officer who committed high treason also received a suspended sentence. My client was tested on a polygraph, he did not kill anyone, – says Lisyansky.

He is convinced that Ukrainian legislation should work in this case. The motives for why people ended up there are different. Accordingly, there should not be identical terms.

Lisyansky added that earlier Danilov, Arestovich and the Ministry of Reintegration had already called on forcibly mobilized Ukrainians to surrender to Ukrainian soldiers, because they are victims. “And what's the point of appearing to them if we are 15 years old?” Lisyansky says.

According to the human rights activist, those who were forcibly mobilized can be judged under Article 260 – participation in illegal armed formations. It provides for punishment in the form of probation, imprisonment in a settlement colony or imprisonment for 3 years.

If we are talking about the rule of law, democracy, then we have the presumption of innocence. It is law enforcement agencies that prove the guilt of a person,” Lisyansky emphasized.

Ukrainians are not Russians

Lysyansky stressed that the forcibly mobilized Ukrainians should be distinguished from the Russians, given a milder punishment, and everything should be done so that they continue to surrender en masse. “The more they are given, the fewer bullets will be fired from the soldiers of the Armed Forces of Ukraine,” he said.

Important! As of April, 23-24 thousand Ukrainians have already died, who were mobilized for a temporary occupied territories. However, it is impossible to accurately calculate this number, because the Russians continue to hide this data. They have imposed limits on the number of people who can attend the funeral. In addition, photography and filming is prohibited.

The human rights activist notes that the Russians are actively using those forcibly mobilized on the defense line. So, recently, almost 17 people died in Avdiivka, because for infidels they are cannon fodder. Consequently, men are encouraged to hide and evade service.

As for the “refuseniks”, they are imprisoned and try to break them. Of course, bullying also takes place.
