It should be noted that this interstate case covers complaints regarding Russia's full-scale invasion of Ukraine on 24 February 2022, as well as the start of Russian aggression in 2014, which included the downing of flight MH17.

As noted by the Ministry of Justice, this case is the largest interstate one in the history of the ECHR, since it unites four applications and covers the period from 2014 to the present day.

Let us recall that the Court’s interim decision already established Russia’s liability on January 23, 2023.

Then the ECHR came to the conclusion regarding the events in eastern Ukraine in 2014 – those territories were under the jurisdiction of Russia, which captured them with its troops.

So it is the aggressor country that should be held responsible for the downing of flight MH17 over the territories it occupies.
