The Cabinet of Ministers has updated the possibilities for booking critical infrastructure workers. The government made the corresponding changes to Resolution No. 76 at a meeting on June 5.

Reservation of employees of defense industry enterprises 2024: main criteria
The Cabinet of Ministers has amended Resolution No. 76, which now allows booking for employees of enterprises of the military-industrial complex, the energy sector and others.

The document provides:
- reservation of 100% of workers by defense industry enterprises that have contracts for the Armed Forces of Ukraine and other military formations for the period of validity of the contracts;
- reservation of 100% of workers by enterprises of the electric power, nuclear, industrial, coal and oil and gas complexes and enterprises that restore or repair destroyed and damaged energy system enterprises;
- reservation of 100% of workers by enterprises that build fortifications for the period of validity of the contract;
- the number of reserved rescuers and police officers may be more than 50%, and with justification and separate approval from the Minister of Defense, up to 100% of the employees of the State Emergency Service and the National Police may be reserved.
At the same time, the reservation period for critical enterprises has been increased from six months to 12 months, and it is also allowed to reserve military personnel with scarce military registration specialties.
The Ministry for Strategic Industries determines the criteria for booking employees of these and other areas not related to critical infrastructure, and the compliance of the documents submitted by the enterprise with these criteria.
The criteria and algorithm of actions for areas not related to the military-industrial complex are in effect in accordance with the challenges of wartime. The website talks about two booking options:
- from 50% of military personnel;
- up to 50% inclusive.
From 50% of workers, regardless of military registration specialty
Organizations, enterprises and institutions that:
- produce goods for the military;
- develop, repair, modernize military and special equipment, as well as spare parts for it;
- manufacture ammunition and other defense products.
They must meet the following criteria:
- Be in the contract execution stage with a state customer in the defense sector or be a co-executor of such a contract, as well as have an agreement on the production of defense goods at the expense of other extra-budgetary sources not prohibited by Ukrainian legislation.
- More than 50% of total production must be defense goods, labor and services (last reporting period).
Up to 50% of employees
We are talking about enterprises operating in the field of industry, space activities or aircraft manufacturing.
Such an enterprise must meet three of the five specified criteria:
- be in the process of executing a contract with a government customer in the field of defense or be a co-executor of such a contract;
- more than 50% of total production must be defense goods, labor and services (for the most recent reporting period);
- the enterprise must be included in the electronic register of participants in the selection and executors of government contracts or agreements;
- the enterprise must participate in the implementation of tasks and activities provided for by state target programs in the field of space activities and the aircraft industry;
- the organization must produce goods, perform work and provide services for defense industry enterprises (which in turn use them to manufacture defense goods).
The decision on whether an enterprise meets these criteria is made by a special working group. It is formed by the Ministry of Strategic Industry and representatives of other government bodies.
Algorithm of actions for booking defense industry workers
The algorithm of actions for enterprises to book workers in 2024 is the same for all options.
To book workers you need:
- Send a letter of appeal and the necessary documents to the Ministry of Strategic Industry to confirm compliance with the specified criteria.
- Wait for a response on making the appropriate decision in accordance with Order of the Ministry of Strategic Industry No. 27 of February 23, 2023.
If the defense industry enterprise meets the criteria, then the Ministry of Strategic Industry makes an appropriate decision and it is recognized as critically important for the functioning of the economy and ensuring the livelihoods of the population during a special period. This is the basis for further booking.
List of documents required for booking defense industry workers
To book defense industry workers, it is necessary to prepare a package of documents according to the criteria.
Criterion 1
- Information about the state contract (agreement) concluded by the enterprise with the state customer in the field of defense, which is in the process of execution, or information about the involvement of the enterprise on the basis of agreements (contracts) in the implementation of such a state contract (agreement);
- letter from the state customer in the field of defense confirming the conclusion of a state contract (agreement) with the enterprise, which is in the process of implementation;
- letter of confirmation in case of involvement of an enterprise on the basis of agreements (contracts) for the implementation of such a government contract (agreement);
- if an enterprise, organization or institution is a co-executor of a state contract (agreement), it is additionally necessary to indicate information about the date, number and validity period of the contract on the basis of which the enterprise is involved in the implementation of the state contract (agreement).
Criterion 2
- Enterprises, organizations, institutions of state ownership must attach the following documents to the application:
- Report on the implementation of the financial plan for the corresponding period (year and quarter).
- Information on confirmation of the volume of production of goods, performance of work, provision of defense services, confirmed and agreed upon by the state customer.
Namely – the name of the type of product according to the industrial product nomenclature (IPP), the product code according to the IPP and the quantity of products produced (gross production).
- Enterprises, organizations, institutions of private ownership must attach the following documents to the application:
- Report on the production and sales of industrial products for the previous year.
- Information on confirmation of the volume of production of goods, performance of work, provision of defense services, confirmed by the state customer.
Namely – the name of the type of product according to the industrial product nomenclature (IPP), the product code according to the IPP, the number of products produced (gross production).
Criterion 3
Information on the order of the Ministry of Strategic Industry on the inclusion of an enterprise, organization and institution in the electronic register of participants in the selection and executors of government contracts (agreements) – in accordance with the Law of Ukraine No. 808-IX dated July 17, 2020 On defense procurement and Resolution of the Cabinet of Ministers No. 233 dated March 17, 2021 years.
To enter an enterprise into the electronic register of participants in the selection and executors of government contracts (agreements), organizations, enterprises and institutions must contact the Ministry of Strategic Industry with the appropriate list of documents.
Criterion 4
Information about the state target program in the field of space activities and the aircraft manufacturing industry, to which the enterprise, institution and organization were involved.
Criterion 5
- Information about the contract (agreement) concluded with an enterprise that is in the process of fulfilling a state contract (agreement) for the industrial production of goods, performance of work and provision of services that are used by the executor of the state contract (agreement) for the production defense goods.
- Letter from the executor of a state contract (agreement) on contractual relations with an enterprise for the industrial production of goods, performance of work and provision of services used for the manufacture of defense goods.
This information must contain information regarding the number, date of the contract (agreement), its validity period and the name of the state customer.
