During the visit, James McGuill met with the leadership of the Bar Council of Ukraine (RAU) and the National Bar Association of Ukraine (NABA), the Board of Trustees for the distribution of charitable funds received from international organizations to help Ukrainian lawyers.

He also spoke at the meeting of the RAU and thanked the NAAU for the transparent and timely distribution of funds received by the organization from international colleagues to help Ukrainian lawyers.

At a meeting with members of the Board of Trustees, the President of the CCBE was told about the number of applications, cases of providing charitable assistance and the procedure for considering applications submitted by lawyers for the provision of charitable assistance. James McGuill assured that he would continue to support Ukrainian lawyers.

In addition, during the visit, the head of the NAAU and the RAU, Lydia Izovitova, presented James McGuill with the badge of the NAAU “Defender of the Bar” for “significant contribution to the development of the Ukrainian bar and high support for the Ukrainian bar, awarding its weight in respecting the rule of law in the world, as well as for promoting opening of borders between Ukraine and EU member states in terms of access to the legal services market and recognition of the qualifications of Ukrainian lawyers”.

Recall that James McGill headed the SSVE in early 2022. A well-known lawyer, practicing since 1986, specializes in criminal and international law, judicial defense in European courts. At the same time, the Council of Bars and Law Societies of Europe was founded in 1960, it represents the lawyers and law societies of 45 countries, and through them the interests of more than 1 million European lawyers.

After Ukraine received the status of a candidate for EU membership, its status in the SSVE changed from an observer to an associate member of the organization. Thus, the Ukrainian Bar Association works directly with European Bar Associations to approach, integrate and facilitate the preparations for Ukraine's accession to the EU. Representatives of the bar associations of the EU countries admit that the Ukrainian legislation on the bar, which was developed as part of the country's European integration process, is currently one of the most progressive in the EU.

On June 24, the Standing Committee of the SSVE adopted recommendations on the qualifications of Ukrainian lawyers. This document opened the borders between Ukraine and the EU member states in terms of access to the legal services market.

CCBE invites legal and bar associations of the EU member states to take the following measures when recognizing the qualifications of Ukrainian lawyers:

  • try to reduce the formalism of the process of recognizing the professional qualifications of Ukrainian lawyers (for example, reduce/cancel the amount of annual fees);
  • publish clear, transparent and easily accessible information, if possible in Ukrainian, on the procedure for recognizing diplomas and professional qualifications in the relevant country, clarifications on the procedures for access to the profession, or allow the exercise of legal services in accordance with the national legislation of that country;
  • consider the possibility of recognizing a functional qualification for Ukrainian lawyers, which can be obtained on the basis of the existing Ukrainian qualifications or through simplified training courses in a language accessible to interested parties;
  • to strengthen cooperation between the EU bar and law societies, as well as their cooperation with the NAAU, including its representations abroad, including through regular exchange information and best practices;
  • take into account that NAAU is the only professional organization of the bar in Ukraine.
