Free Legal Aid lawyers told ICTV Facts whether a delay in mobilizing volunteers is possible. They noted that, according to Article 23 of the law on mobilization preparation and mobilization, there is a clear list of categories of citizens who are not subject to mobilization. This list does not contain a basis giving the right to exemption from the mobilization of volunteers.

However, unlike many other persons liable for military service, the status of a volunteer gives the right to travel abroad for a certain period, subject to the availability of appropriate documents and the purpose of the trip.

As you can see, a deferment from the mobilization of volunteers is impossible, since there is no law that would clearly indicate the possible deferment of volunteers.
BPP lawyers noted that there is only a bill that was registered by the Verkhovna Rada of Ukraine in November on amending the article of the law on mobilization preparation and mobilization. Its authors propose to exempt volunteers from conscription.
In the explanatory note to bill No. 10251 on amendments to Article 23 of the Law of Ukraine On mobilization preparation and mobilization it is stated that volunteer activities, as a rule, are carried out by those citizens who, by age and formally due to health reasons, are liable for military service, but for various reasons cannot actually serve in military units and perform combat and other tasks.
Therefore, each case giving the right to a deferment from the mobilization of volunteers is considered individually.
