Specific reasons must be provided for refusing to receive a summons. This was stated by lawyer Rostislav Kravets.

In what cases can you refuse the agenda

According to Kravets, you need to carefully read and carefully reread the agenda that is handed to you. If there is an error in it, then this is the basis to refuse the summons.

So, it is possible to refuse the summons if the specified data are incorrect in it or on the condition that it is handed over by an unauthorized person. By the way, a representative of the TRO or the police does not have the right to issue a summons, but only a person authorized by the military registration and enlistment office.

The lawyer noted that it is also possible to refuse the agenda if it does not have the seal of the military registration and enlistment office or the signature of the military commissar. By the way, if an error was found in the completed subpoenas and you refuse to sign, the officer of the military registration and enlistment office must draw up an act of refusal to receive in the presence of witnesses.

The subpoena must contain the following data:< /p>

  • Name;
  • year of birth and address of recruit;
  • place of work;
  • type of agenda;
  • date, time and address, when and where you need to appear;
  • name of the body, seal, signature, last name, first name and patronymic of the head of the military registration and enlistment office.

Punish for refusal of the subpoena

The lawyer stressed that there is no liability for refusal of the subpoena for good reasons. But a fine can be issued when a person has violated the rules of military registration.

So, after a refusal and drawing up an act, the case is submitted for consideration to the heads of the recruitment center, which can charge a fine from 850 to 1,700 hryvnia.< /strong>

Can they be forcibly delivered to the recruiting center

Any forced actions to keep a person liable for military service are illegal and are not provided for by law. So cases of detaining a person are possible only by the police when committing or attempting to commit a criminal offense.
