The OP wants to reform the Constitutional Court/Exchange rate
< strong _ngcontent-sc87="">The Office of the President said that the country needs a new judicial reform, since the previous one made the Constitutional Court inviolable. Now the Presidential Office is proposing to rethink the need for the existence of the Constitutional Court.
In an interview with Radio Liberty, Deputy Head of the Office of the President Andrei Smirnov said that Ukraine needs a new judicial reform with a rethinking of the need for the existence of the Constitutional Court.
In his opinion, the reform that was carried out during the term of the previous president, Petro Poroshenko, should be curtailed.
I emphasize that the constitutional reform that was carried out during the time of Petro Alekseevich Poroshenko created the Constitutional Court as a body that is generally inviolable compared to any other state body. Therefore, I consider this reform a shameful phenomenon that needs to be curtailed and a new reform should be made, in which the need for the existence of the Constitutional Court should be rethought, – said the deputy chairman of the OP.
Smirnov said that the Office of the President wants to get an answer to the question of how exactly the Constitutional Court should look after the reforms. To help in this, the constitutionalists, who are now actively participating in the council for the restoration of the country, said the deputy chairman of the OP.
Why they want to reform the Constitutional Court
The Constitutional Court after the reform has become notorious. The “star” of the Constitutional Court was the judge of the Constitutional Court Oleksandr Tupitsky.
- In December 2020, Volodymyr Zelensky removed Tupitsky from the post of chairman of the Constitutional Court of Ukraine. Already in March 2021, the President canceled the decree of the fugitive Viktor Yanukovych for 2013, according to which Alexander Tupitsky and Alexander Kasminin were appointed judges of the Constitutional Court.
- The law does not give the president the authority to dismiss judges of the Constitutional Court. Only judges of the Constitutional Court can do this, so Tupitsky and Kasminin appealed Zelensky's decree to the Supreme Court. They considered the actions of the President unlawful.
- Also in December 2021, the United States imposed sanctions against Tupitsky due to significant corrupt practices. Sanctions were also imposed on his wife. In January 2021, the State Bureau of Investigation informed Tupitsky of the suspicion. They believe that he gave false testimony, bribed a witness. And then Tupitsky was also suspected of arbitrariness.
- On May 15, the term of office of Alexander Tupitsky, a judge of the Constitutional Court, expired. Tupitsky himself was seen abroad during martial law. Journalists caught Tupitsky in Vienna: on March 24, he was leaving the local hotel Stefani. He was photographed there.
