There is no separate legal act regulating the service of subpoenas during martial law in Ukraine. However, the Regulations on the preparation and conduct of the conscription of citizens of Ukraine for military service of 2002 are in force.
It provides that notification of citizens about the conscription is carried out by order of the military commissars of regional and district territorial recruitment centers and social support. At the same time, if errors are found, the person may refuse to sign.
When it is possible not to sign the subpoena
If the agenda contains errors, you should not sign it. To do this, you should check whether it indicates:
- last name, first name, patronymic, as well as the address of residence of the recruit;
- type of agenda;
- list documents that you need to have with you;
- duties of a conscript;
- what type of troops the conscript is assigned to;
- date, time and address – when and where you need to go;
- name of the body, seal, signature, full name of the head of the territorial recruitment and social support center.
A draftee who discovers an error may note that it was compiled with violations. Comments can be made either orally or in writing. Despite the fact that there is no separate field for this in the agenda, a note can be placed in an empty place by putting the date and signature.
Important! It is illegal to enter information on the agenda in front of the conscript. Everything must be completed and signed at the military enlistment office for delivery.
However, if the summons is filled out correctly and does not contain errors, the person is obliged to accept, sign, and, within the period specified in the document, appear at the territorial center 2-3 days after delivery.
What happens if you refuse to receive the summons
If the document is filled with errors, the person has the right to refuse the summons. It is best if witnesses are present at the same time.
After the refusal, the authorized persons will draw up an appropriate act and transfer it to the territorial recruitment and social support center. However, refusal may provoke increased attention to the conscript.
Should I go to the territorial recruitment center if the conscript did not sign
If the summons was sent through relatives or neighbors, and the potential recruit did not sign, it may not appear in the TCC and SP. A telephone conversation is also not a reason to contact the center.
In general, a conscript is not obliged to do what is not provided for by law, even taking into account martial law in the country.
