Martial law continues in Ukraine due to the war unleashed by Russia. At the same time, all men liable for military service between the ages of 18 and 60 are subject to mobilization. However, many of our fellow citizens left Ukraine before February 24, but never returned.
Therefore, a logical question arises whether there is any responsibility for men who left before the start of a full-scale war and did not return. This issue was clarified by lawyer Rostyslav Kravets.
According to the expert, responsibility for not returning to Ukraine during martial law has not been established.
To date, there is no such responsibility. People's deputies are trying, there were several bills that were intended to introduce responsibility for the non-return of men to Ukraine, – the lawyer explained.
He stressed that the adoption of such a law would not meet the norms of the Constitution of Ukraine.
“As for forcing men to return, in fact, this is not only a violation of the Constitution, but also a violation of logic. After all, the flow of finance to Ukraine from workers begins to exceed income from exports,” Kravets added.
Are men in danger of fines or community service
The lawyer noted that the introduction of administrative liability, in particular fines for returning men, would be a violation of the Constitution and human rights. who was abroad before the war,” he concluded.
Kravets stressed that if a man received a summons, but he somehow went abroad after February 24, 2022 and did not appear at the military registration and enlistment office, then administrative responsibility is provided for this. In other cases, there is no responsibility for non-return.
Let's add that civil servants who were previously unfit for military service were forbidden to go abroad. This applies in particular to both women and men. Now officials can cross the border only for the purpose of a business trip. To do this, they need to submit relevant applications to the GNSU 3 days before departure. This applies in particular to:
- people's deputies,
- judges,
- prosecutors,
- as well as employees booked by authorities state authorities for the period of mobilization.
Recently, the head of the personnel department of the headquarters of the Command of the Ground Forces of the Armed Forces of Ukraine, Colonel Roman Gorbach, said that there were no waves of mobilization. According to him, the Armed Forces of Ukraine currently need specialists, both for new types of weapons that our partners give us, and for replenishing losses. Gorbach explained that, first of all, they mobilize personnel in certain military specialties.
