EU tightens sanctions against Belarus to avoid circumvention of restrictions

The EU Council has adopted a number of sanctions against Belarus, which are already in force against Russia for waging war against Ukraine.

It is noted that the sanctions are aimed at various sectors of the Belarusian economy — trade, services and transport.

With its decision, the EU Council continues to ban the export of dual-use and advanced technologies, and also introduces additional restrictions on the export of goods that could help strengthen Belarusian industrial potential. The EU also prohibits the transit of these goods through Belarus.

Ban on trade in gold and oil

According to the decision, additional restrictions are imposed on the export of goods and technologies for maritime navigation and luxury goods to Belarus.

In addition, a ban has been imposed on the import and purchase of gold and diamonds from Belarus, as well as helium, coal and mineral resources, including crude oil.

This clause was also supplemented with a ban on the export of goods and technologies suitable for use in oil refining and liquefied natural gas.

Ban on services for Belarus

The sanctions provide for a ban on the provision of certain services to Belarus, the government of the country, corporations, government agencies, or any individual or legal entity acting on their behalf or at their direction.

We are talking, in particular, about accounting, architectural and engineering services, advertising and marketing research services, sociology, product testing and technical control.

The ban on the transport of goods by road in the EU with trailers and semi-trailers registered in Belarus is also expanding.

To minimize the risks of circumventing sanctions, EU operators that are 25% or more owned by Belarusian individuals or legal entities are prohibited from becoming road transport enterprises or transporting goods by road within the EU, in particular in transit.

The EU Council also noted that EU exporters should include in their future contracts a clause prohibiting re-export to Belarus or re-export for use in Belarus of sensitive goods and technologies, war-related goods, firearms and ammunition.

Recall that on June 26, ambassadors of countries — members of the European Union approved a new package of sanctions against Belarus for supporting Russia’s war against Ukraine.
