ECHR decision will become the basis for a special tribunal on Russian crimes – authorized representative Sokorenko

Commissioner for the European Court of Human Rights Margarita Sokorenko reports that the ECHR decision recognizing the systemic and massive human rights violations committed by Russia against Ukraine will become the basis for a special tribunal.

She announced this during an online briefing on Wednesday, July 9.

Special Tribunal for Russian Crimes – What Does It Mean?

This use of the ECHR decision will be possible due to the fact that the court “specifically described the context of Russia’s military aggression,” Sokorenko noted.

– Regarding the special tribunal on aggression. In my opinion, this decision will be very useful in the work of the future special tribunal on aggression… The ECHR very specifically described the context of the military aggression of the Russian Federation… The conclusions (of the ECHR) should become the basis for the work of the special tribunal. I think that this will be the case in the future , – she said.

The Commissioner believes that the ECHR has shown that Russian rhetoric clearly demonstrates the Kremlin’s goal of destroying Ukraine as a subject of international law.

What other consequences await the Russian Federation after the ECHR decision

The Commissioner for ECHR Affairs also believes that one of the consequences will be that it will become easier to consider those individual complaints to the ECHR against the Russian Federation that have already been filed earlier.

She explained that the court can now only consider those individual claims that have already been filed, and the consideration of new ones is no longer within the jurisdiction of the ECHR.

“The European Court will not accept the corresponding complaints (individual)… But this does not mean that there are no violations to which Ukrainians are subjected,” Sokorenko said.

Let us recall that on July 9, the ECHR announced that it was Russia that was guilty in the case of Ukraine and the Netherlands v. Russia.
