Free Legal Aid lawyers note that military personnel do not have the right to drive a vehicle without a driver's license, even during martial law or while on duty.

The Law of Ukraine On Road Traffic (Article 16) clearly states that every driver must have a driver's license of the appropriate category.

Military status or service does not provide an exception to this requirement, the BPD lawyers emphasized.

Lawyers added that military personnel can only drive those types of transport for which they have permission to drive (that is, the appropriate category of driver's license).

Even if the vehicle is a company vehicle, the driver must still have a driver's license and a technical certificate for the vehicle.

However, during martial law, it is possible to use a driver's license if it has expired. That is, if a serviceman is unable to renew his license, he can use the old one.

Responsibility for driving without a license – what is provided for by the military

Article 126 of the Code of Administrative Offences of Ukraine provides for administrative liability for drivers:

  • driving a car without a driver's license – fine 425 UAH;
  • driving a car by a person who does not have a driving license, or for handing over the steering wheel to such a person – a fine of UAH 3,400 ;
  • driving a car while intoxicated – 17 thousand UAH and deprivation of rights for 1 year, if the violation is committed again within a year – a fine of 34 thousand UAH and deprivation of rights for a period of 3 years;
  • driving a vehicle while deprived of the right to drive – UAH 20,400 ;
  • repeated violation within a year after confiscation of rights – 40,800 UAH.

If the driver refuses to pay the fine within 15 days, the liability (fine) is doubled.
