Deferment from mobilization to care for parents: who is granted it and what documents are needed

On May 16, 2024, Cabinet Resolution 560 was adopted. It was in this resolution that a significant number of changes appeared regarding the right to a deferment from mobilization. In particular, in Appendix 8 Article 23 of the Law of Ukraine On Mobilization Preparation and Mobilization, new documents have appeared that are needed in order to obtain a deferment from mobilization to care for parents.

Delay from mobilization to care for parents: how to apply

First of all, you need a document that proves that the father or mother needs care. This is a certificate for the examination report by a medical and social expert commission in the form approved by the Ministry of Health or the conclusion of the medical advisory commission of a healthcare institution about the need for constant care.

If the father or mother has other children or relatives, then it is necessary to prove that other family members cannot provide constant care.

List of documents to obtain a deferment for parental care:

  • Appendix 5 of the Cabinet of Ministers resolution states that the list of documents includes a birth certificate. It is this that certifies that the person who needs care has family ties with the person liable for military service.
  • Documentation confirming that another family member is unable to care for the person. Such a document may be an extract from the conclusion of a medical and social expert commission or the VKK of a healthcare institution.
  • It is necessary to prove that another family member has certain health defects or a disability group and cannot care for elderly parents, because he himself needs care.
  • In the event of the death of a family member who could provide care, except for a person liable for military service, you need to add a death certificate. Such a document can be < strong>certificate from the court that a family member who can care for the parents is missing or declared dead.
  • You need to add an extract from the unified register of missing persons.
  • To receive a deferment for parental care, it is mandatory an act must be attached , establishing the fact that a person liable for military service provides permanent care, in accordance with Appendix 8. It is in this act that it is noted that other family members cannot care for the parents.

If a person liable for military service is the guardian of a person who has been declared incompetent by a court, then you need to add a court decision that the person is actually recognized as incompetent, as well as an extract on the appointment of a guardian.
