Conscript's electronic account: a lawyer told when and how they can earn money

In the government draft law on military service, mobilization and military registration No. 10449, a clause appeared that subpoenas to the territorial center of recruitment and social support (TCC and SP) can be sent through an electronic account. < /p>

ICTV Facts asked a lawyer from the law firm Bachinsky and Partners Anastasia Gerich, how exactly will personal electronic accounts work.

In addition to the adoption of the bill in parliament, it is also necessary to prepare software and give people a certain transition period, because everyone will not be able to register in two or three days. Therefore, it is unlikely that everything will work overnight.

Responsibility to monitor the electronic account

In Ukraine, there is a provision that when registering in an electronic court, the parties are required to independently monitor their case. Here we can draw a parallel with the electronic office of a person liable for military service.

According to the lawyer, it is likely that this could be the case with conscripts or reservists.

— If a person has registered there and has access to an electronic account, then his responsibilities may include monitoring the current status of his military records. And this is normal,” notes Anastasia Gerich.

The government draft law does not stipulate exactly how the military should check personal accounts. However, it is noted that the day of service of the summons is :

  • day of delivery of such a summons against signature,
  • day of receipt by the territorial recruitment center of the message about the delivery of such a summons to the conscript’s electronic account.

If the summons was sent to the electronic account after 17:00, then it is considered served on the next business day, regardless of the receipt of a message about its delivery by the TCC.

Limited availability and reservations from the company

The presence of a person’s armor from mobilization from an enterprise or status of limited fitness is not a reason for failure to appear at the TCC. Because territorial centers, in addition to issues of conscription and mobilization, are also engaged in collecting and updating personal information about each person liable for military service.

And every conscript or reservist must comply with the rules of military registration: undergo military medical commissions, update his credentials, report a change in place of registration or work.

All this today can only be done in the TCC premises.

However, when electronic accounts are introduced and a person has the right to a deferment and passes the IVC, he will be able to update information about himself within the electronic account.
