Switzerland became the 39th country to support this initiative. The Swiss side is convinced that the crimes of military aggression committed against Ukraine should not go unpunished.

Switzerland advocated the creation of a special tribunal for Russia

Switzerland has officially joined the main group of countries supporting the creation of a special tribunal. This decision was made during a meeting in Berlin on November 16, at which the country was represented by Ambassador Franz Perez, head of the Office of Public International Law of the Swiss Ministry of Foreign Affairs.

Participation in this core group complements Switzerland's support for national and international efforts to prosecute and bring to justice all international crimes committed in Ukraine, the Foreign Ministry said in a press release.

The Swiss Foreign Ministry said the International Criminal Court has the power to prosecute and trial war crimes and crimes against humanity committed in Ukraine. However, it has no jurisdiction over the “crime of aggression” in a full-scale war, since neither Russia nor Ukraine have ratified the Rome Statute.

In addition to supporting the creation of a special tribunal for Russia, Switzerland intends to seek a revision of the Rome Statute. The purpose of the review is to facilitate the jurisdiction of the ISS for the “crime of aggression” in all contexts.

The EU presented a possible format for a special tribunal for Russia

  • During his visit to Brussels, Ukrainian Foreign Minister Dmitry Kuleba met with European Commissioners Oliver Varhelyi and Didier Reynders. They presented to Kuleba the EU's vision on the possible form of a special tribunal to condemn the crime of Russian aggression against Ukraine
  • The European Commissioners stressed that discussions about a possible special tribunal are still underway. However, they stressed that the discussion of this issue is a “movement from a dead point.”
  • Previously, Kuleba condemned Western countries for not creating a special tribunal for Russia. He noted that our partners in some places lacked the freedom to do this.
