Martial law has been in effect in Ukraine for more than 11 months. Men liable for military service from 18 to 60 years old are subject to mobilization.

The summons can also be handed over to those removed and excluded from military registration in Ukraine. Vladislav Zaitsev, a lawyer-volunteer of the ULA Hotline on issues related to military aggression, its consequences and martial law, spoke about this.

Both categories can serve a summons

As the lawyer noted, the current legislation of Ukraine distinguishes between the concept of “withdrawal” and “exclusion from military registration.” This also affects the issues of mobilization of citizens. The fact is that the legislator regulates the possibility of conscription of those removed and excluded from military registration in different ways.

Both categories can be served with a summons. After all, when it is handed over, authorized persons do not establish the presence or absence of the fact of a deferment from conscription. These issues are dealt with directly by the draft board,” said Zaitsev.

Therefore, it is imperative to appear at the Territorial Center for Recruitment and Social Support (TCC and SP) on the set date and time.

It should be understood that the law does not include among the categories of citizens who are not subject to military service during mobilization removed from military records. They can also be mobilized subject to passing a medical examination.

Exclusion from military registration

As for those excluded from military registration, they also do not fall under the category of those who have a deferment from conscription . At the same time, for example, if a military man was dismissed from service on the basis of the conclusion of the military medical commission (VLK) on unfitness for service with exclusion from military registration, his subsequent mobilization is excluded.

However, if such an exception occurred during a full-scale war, there is a possibility of being called to the VLK for re-examination and health checks. for military service, – said Zaitsev.
