Who can be excluded from military registration?

Men who, in accordance with Part 6 of Article 37 of the Law of Ukraine On Military Duty and Military Service, are not subject to mobilization during martial law, may be excluded from military registration.

  • Persons who have reached the maximum age for being in the reserve, that is, after 60 years.
  • Convicts who are deprived of liberty for serious or especially serious crimes.
  • Unfit for military service according to the conclusion of the Military Medical Commission.
  • Persons whose Ukrainian citizenship has been terminated.

Excluded from military registration: is it possible to travel abroad in 2025

According to lawyers, in order for a person to be able to travel abroad, especially if his age is between 18 and 60 years, the exclusion from military registration must be formalized in an appropriate manner, in an official manner.

— The military registration document must have a corresponding mark on exclusion from military registration, as well as a seal. In addition, the information must be updated in the register of military personnel Oberig. This register also indicates the reasons for which the person was excluded from military registration, — say lawyers.

Therefore, even if a person is found unfit for military service during martial law, this does not mean that he will be able to cross the border of Ukraine without hindrance. After all, it is necessary that the entire procedure be carried out in the appropriate legal order. A person who is excluded from military registration must submit an application to the TCC for exclusion from registration and receive the results.

— This all means that you need to have documents that confirm the status of exclusion from military registration. Even if the military ID at the TCC has a stamp Excluded from military registration , this is not enough to leave the territory of Ukraine. Only after information about the exclusion appears in the Oberig registry, a person will be able to travel abroad, — the lawyers assure.

Is it possible to travel abroad if you are removed from military registration, and what documents do you need to have?

Free legal aid lawyers note that border guards will require the presentation of a military registration document with the corresponding mark and seal on exclusion from military registration, as well as a certificate from the VVK on unfitness for military service.

As for men who have already reached 60 years of age, they also have the right to freely cross the state border, because they are not subject to military service. But again, it is necessary for the TCC to make a corresponding note through the Oberig registry that the person has reached the maximum age and is excluded from military registration.

— According to Part 6 of Article 37 of the Law on Military Duty and Military Service, the basis for exclusion from military registration is also the termination of Ukrainian citizenship. That is, if a person is no longer a citizen of Ukraine, he can travel abroad, — the lawyers noted.

In some cases, the TCC requires a person who has been removed from military registration to re-register due to the obsolescence or loss of documents on complete unfitness for military service. In such a case , the person will have to prove again that he is unfit for military service.

It is also possible to appeal to the court, because in accordance with the law, exclusion from military registration is for life or until the corresponding changes appear in the Law on Military Duty and Military Service. In accordance with these changes, persons excluded from military registration will have the right to be re-registered for military service.
