During martial law, men aged 18 to 60 have limited rights to travel abroad. However, exceptions are provided for certain categories of citizens, in particular, this applies to people who are not subject to mobilization, as well as reserved workers. Do people with a deferment have this right?

Which teachers can get a deferment from mobilization?
According to the Law of Ukraine On Mobilization Preparation and Mobilization and the Resolution of the Cabinet of Ministers No. 560 of May 16, 2024, certain categories of citizens have the right to a deferment from conscription. Such categories include education workers who are directly involved in organizing and conducting the educational process.

In accordance with paragraph 2 of part 3 of article 23 of the above-mentioned law, the following are not subject to mobilization during the period of martial law:
- teachers and scientific and pedagogical staff of universities and institutions of professional higher education;
- employees of scientific institutions who have an academic degree;
- teachers of vocational or vocational-technical education institutions;
- teachers of comprehensive schools.
Thus, teachers performing pedagogical or scientific-pedagogical functions in educational institutions have the legal right to a deferment from mobilization for a period of one year, including during the summer holidays. But it is worth noting that they must be officially employed.
Thus, teachers can take advantage of the right to a deferment from mobilization if they are officially employed at their main place of work in institutions of higher or professional pre-higher education, scientific institutions, organizations, as well as in institutions of general secondary or professional (vocational and technical) education.
A mandatory requirement is a workload of at least 0.75 of a full-time position , with a corresponding number of teaching hours.
In addition, the management of the educational institution must confirm that this employee is critically necessary for the stable functioning of the institution and the continuous conduct of the educational process.
Can a teacher go abroad on vacation with a deferment?
Lawyers from Free Legal Aid noted that if a teacher has a deferment, specifically as a teaching employee of a secondary education institution, then, unfortunately, he cannot travel abroad.
The lawyers of the BPD emphasized that if the issue concerns scientific and scientific-pedagogical workers of institutions of higher and professional pre-higher education, scientific institutions and organizations that have an academic degree, as well as teaching staff of institutions of professional pre-higher education, professional (vocational and technical) education, institutions of general secondary education, then (according to paragraph 2 of part 3 of Article 23 of the Law of Ukraine On mobilization preparation and mobilization) travel abroad is not permitted .
That is, if a teacher has a deferment based on this clause, then the teacher does not have the right to travel abroad, lawyers say.
