Accompanying a person with group II disability abroad: who is eligible and what documents will be needed

During martial law, the travel abroad of men liable for military service between 18 and 60 years of age is limited. Certain categories of persons have the right to cross the border. Now such a right is granted to persons who have a wife with a disability of I, II, III groups or parents or parents of a wife with a disability of I and II groups.

The following may accompany a person with a disability outside of Ukraine:

  • persons who are related to a person with a disability (spouses, children may accompany their parents or vice versa);
  • a legal or natural person constantly caring for disabled people (with supporting documents);
  • representative of an organization providing social work caring for people with disabilities.

Accompanying a person with a group II disability: how to travel abroad

In accordance with Resolution of the Cabinet of Ministers of Ukraine No. 57 of January 27, 1995, during martial law, those citizens of Ukraine who constantly care for persons with disabilities of groups I and II, accompany persons with disabilities of group II, and children with disabilities of group II have the right to cross the state border groups and persons in need of constant care.

According to the rules, you can only cross the border through a checkpoint accompanied by a person with a disability. That is, the mere fact of having a person with a disability does not grant a person liable for military service the right to independently cross the border.

It is possible to independently cross a checkpoint without a person with a disability only if such a person is already abroad. To do this, the border service officer must provide a certificate of the stay of a person with a disability with consular registration in another country.

Please note : accompanying persons must return to Ukraine no later than the person they accompanied. If a person with a disability returns from abroad without an accompanying person, this will be considered a violation.

What documents will be needed to travel abroad with a person with a group II disability?

To cross the border, you must provide a full package of documents, the list of which depends on who is accompanying and who is being accompanied.

Accompanying a wife with a disability

A wife with a disability can be accompanied at the border by her official husband if he has documents confirming his disability and family ties:

  • MSEC certificate of disability group II;
  • Marriage certificate;
  • pensioner's ID.

Accompanying your own parents or your wife's parents

To cross the border when accompanied by your own parents or your wife’s parents, you must have the following documents:

  • documents confirming family ties and cohabitation – an extract from the demographic register about registration at the same address, birth certificate, marriage certificate;
  • MSEC certificate of disability group II;
  • pensioner's ID;
  • a certificate from the VKK about the need for constant outside care for a person with a disability;
  • the act of establishing permanent outside care for a person.

Accompanying children with group II disabilities

Children with disabilities can be accompanied by a mother or father, guardian, trustee, foster parents, or parent-educators when traveling outside of Ukraine. Accompaniment can also be provided by an adult brother, sister, grandmother, grandfather, stepmother, stepfather, taking into account their belonging to the list of categories of persons exempt from military service and mobilization. This is possible if they have the appropriate supporting documents and documents confirming family ties.

To travel outside of Ukraine when accompanied by children with disabilities, you must:

  1. Documents confirming family ties (if accompanied by father or mother);
  2. Documents confirming the relevant powers of the person accompanying a child with a disability – in the case of accompanying a trustee, guardian, parent-educators, one or both adoptive parents).

The above documents can be provided either in original or in the form of a notarized copy. Persons may be refused to cross the border if they have not provided a full package of documents.

Features of accompanying a person with group II disability abroad

Upon arrival of a person with a disability and an accompanying person at a place of temporary stay outside of Ukraine, it is necessary to contact the consular office of Ukraine in the host state within one working day to register persons with disabilities for consular registration.

The consular office is obliged, through the Ministry of Foreign Affairs, to inform the Ministry of Social Policy and the National Social Service within one working day about the registration of persons with disabilities who need constant care at the consulate.
