On February 5, against the background of news about the possible resignation of the current head of the Ministry of Defense Alexei Reznikov, the Servant of the People announced that the head of the Main Intelligence Directorate could be appointed to his chair Kirill Budanov (that is, a military man).

However, since 2018, according to the current Ukrainian legislation, only a civilian can be the Minister of Defense (former military personnel dismissed from the ranks of the Armed Forces of Ukraine are also considered civilians).
Servant of the People and Deputy Chairman of the Committee on National Security and Defense and Intelligence Marianna Bezugla said that the faction had prepared legislative changes that would allow the appointment of the Minister of War during martial law.
Those legislative changes that we have prepared, they are, they have been worked out within the framework of the major bill 4210. There is a proposal there on the possibility of holding the position of minister of the military only under martial law,” said MP Maryana Bezugla.
According to her, , the draft law is already ready for consideration in the session hall and can be voted “even urgently”.
Bill 4210, mentioned by Marianna Bezugla, aims to clarify a number of legislative provisions in the field of national security and defense. It was voted by the parliament as a basis on February 16, 2022, but still remains not accepted as a whole.
In the edition of that time, it does not contain provisions on the possibility of appointing a person from the military as the Minister of Defense. But as of February 16, 2022, martial law was not yet in effect in Ukraine.
