“The Sound of Democracy in Action”: Woman Sues to Give Car Horns the Right to Freedom of Speech

According to the American, the car horn is an expression of freedom of speech, and not just a warning to pedestrians and drivers.

US citizen Susan Porter, convicted in 2017 of honking her car horn 17 times outside the office of Deputy Darrell Issa, wants to implement changes to the First Amendment, preserving the right to free speech. We are talking about atomic signals, which, according to Susan, are an expression of opinion and position, and therefore should be protected by law.

Six years ago, she was fined for using a car horn during a rally.

The woman was acquitted by an appeals court in 2023, but now she is seeking to protect other drivers from possible penalties related to the right to honk their car, her lawyers say.

Now Porter is challenging a California Vehicle Code law that requires car horns to be used only in two situations: to “audibly warn” other drivers and as a theft alarm.

The California woman's lawyers argue in an appeal filed with the Supreme Court that car horns should be protected by the First Amendment, which preserves the right to free speech.

“The car horn is the sound of democracy in action,” they note.

Note that in the USA, for example, in New York, you can only honk in case of a warning about danger. In May 2022, New York City Councilman Eric Boettcher filed a bill that proposed doubling fines for excessive honking to $2,000 for a first offense.
