Asiya Mukhamedshina, a member of the Association of Lawyers of Russia, called the procedure to be followed if someone came to you with a search. According to her, first of all it is necessary to monitor the progress of investigative actions. Her words are quoted by RIA Novosti.
First of all, when the investigators appear on the doorstep, it is necessary to find out the reason for the visit, then ask for a search warrant.
“You can say that you call your lawyer so that he is present during the search by the police. The main thing is not to be nervous, calm down and monitor the progress of the search — this is the sequence of the search, for example, they should inspect room after room with witnesses, otherwise you can make comments in the protocol,” the lawyer advises.
Mukhamedshina also recommended that the case number, address and full name be checked in the search warrant. The resolution itself should be photographed.
The lawyer stressed that first of all it is important not to say anything during the interrogation without a lawyer, referring to article 51 of the Constitution or article 46 of the Code of Criminal Procedure (CPC).
Earlier, the State Duma adopted amendments to the law “On Police” in the second and third readings, expanding the powers of police officers — under certain conditions they will be allowed to open cars and enter apartments. So, the police can open a car if it is required to save someone’s life, if it is required to ensure the safety of citizens during mass riots or emergencies, in case of a threat of a terrorist attack or to detain suspects.
