Moscow. August 2. INTERFAX.RU – The Magistrates' Court in Moscow on August 26 will consider the case against WhatsApp for the messenger's refusal to localize the data of Russians on the territory of the Russian Federation.
“The court session is scheduled for August 26 at 12:00,” the court said on Monday.
Last Friday, July 30, the administrative protocol against WhatsApp for the messenger's refusal to localize the data of Russians on the territory of the Russian Federation was registered in court.
Roskomnadzor previously drew up an administrative protocol in relation to the messenger under Part 8 of Article 13.11 of the Administrative Offenses Code of the Russian Federation (Violation of the legislation of the Russian Federation in the field of personal data) and sent it to court. The punishment for this offense provides for fines from 1 to 6 million rubles.
Earlier, the court received similar protocols in relation to Facebook and Twitter.
On July 29, a court in Moscow fined Google LLC 3 million rubles for refusing to localize the data of Russians on the territory of the Russian Federation. This is Google's first fine for refusing to localize databases of Russian users in the Russian Federation.
As explained in Roskomnadzor, the leadership of the American company could not confirm the fact of the localization of the databases of Russian users in Russia.
Earlier, Roskomnadzor told Interfax that it demanded that Facebook, Twitter and Google report on data localization by the end of May. Among the companies that localized data in the Russian Federation, they named Apple, Microsoft, Samsung, PayPal, Booking, LG.
In Russia, the LinkedIn social network has already been blocked for violating the localization requirement. In 2016, the Tagansky Court of Moscow satisfied the corresponding claim of Roskomnadzor.
The issue of localizing data of Russian citizens on the territory of the Russian Federation by social networks Facebook and Twitter has been discussed with companies since 2015.
