A 6-year-old Texas boy who was beaten with a baseball bat by a neighbor in his home has died after two months in the hospital.

Jeremy Diaz was hospitalized Sept. 11 after suffering skull fractures and brain swelling during an early morning seizure, according to sheriff's deputies. Neighbor Daniel Logan struck Jeremy and Logan's mother with a baseball bat after they entered the Diaz home, according to a Williamson County Sheriff's Office detective's probable cause affidavit.
Jeremy passed away on Tuesday morning, November 14, his father wrote on one of the platforms.
“I looked at him and noticed a pale face and eyes without movement. Then his heart stopped,” Arturo Diaz wrote. “They tried to resuscitate him, but to no avail. He fought for over 60 days and his condition improved, but in the end it seemed like the odds were against him and he gave up.”
Diaz called his son a wonderful and loving child who treated others the way he wanted to be treated.
Logan, 39, is now charged with two felonies: battery to a child and aggravated assault with a deadly weapon on a family member.
A spokesperson for the sheriff's office wrote on Facebook that if warranted, they will work with the District Attorney's Office to present the brutal homicide case to a grand jury.
Logan's lawyer, Mark Chavez, told CNN they are keeping Jeremy's family in their prayers.
“This whole situation is heartbreaking. While the allegations are troubling, we ask everyone to reserve judgment until all the facts are clear, especially while we are investigating issues related to serious mental illness,” Chavez said. “By then, we will keep this family in our thoughts, hoping they find peace during this tragic time.”
What happened according to the affidavit
At 5:17 a.m. on September 11, Williamson County police responded to a disturbance call in Georgetown, Texas.
Logan's wife, Kristen, told police she was awakened by a knock on the door. According to testimony, she saw the back door of her home open and a fresh hole in the fence. She also saw that the glass on the back door of her neighbor's back patio was broken.
Kristen Logan said she then heard her mother-in-law, Cynthia Logan, yelling from her neighbor's house to call 911. She also heard another woman screaming. The elder Logan emerged through the patio door, her face covered in blood, the wife said in the affidavit.
According to a detective who interviewed Cynthia Logan at the hospital, she said she saw Daniel walking up the stairs of a nearby house. Cynthia Logan said she also went upstairs and found the baby lying in the bedroom. She said she was hit with the bat when she told Daniel Logan to stop after he confronted her husband at the house, the affidavit said.
A hospital discharge note said Cynthia Logan suffered swelling around her left eye, a cut to her face and lost one tooth, the court document said.
Daniel Logan is being held on bonds totaling $650,000, according to online jail records. He was declared incompetent to stand trial in October. His mental health hearing is scheduled for Nov. 28, according to criminal records posted online.
