Should Ukrainian refugees declare financial assistance and pay taxes on it: Ombudsman's explanation

Millions of Ukrainians are forced to seek asylum abroad.

Ukrainian refugeeswho, due to the full-scale offensive of the Russian Federation, were forced to go abroad and receive financial assistance there, must reflect these incomes in the declaration, but do not need to pay tax.

This was stated by the Commissioner of the Verkhovna Rada of Ukraine for Human Rights Dmitry Lubinets in Telegram.

Lubinets reminded that millions of Ukrainian citizens, forced to seek asylum in other countries after the start of a full-scale war, receive financial and material assistance from foreign states and their state funds, foreign campaigns and organizations.

He explained that according to the Tax Code, taxpayers are required to file an annual declaration of assets and income with the subsequent payment of taxes. However, current legislation provides for a exception from taxation of income abroad. This applies to persons and family members of the first degree of kinship who suffered as a result of Russia's armed aggression and who exercised their right to temporary protection abroad and receive assistance from foreign states and their state funds.

“So, citizens of Ukraine who have exercised the right to temporary protection in other countries of the world are required to declare as foreign income the assistance received from foreign states, their state funds, foreign companies and organizations. At the same time, the tax on this foreign income and the military tax on the amount of such assistance is not determined and not paid,” the Ombudsman explained.

Citizens of Ukraine can file a tax return electronically through the Electronic Office in the section “EC for citizens” – “Tax right to property and income” .

Recall that Poland has changed the rules of stay for citizens of Ukraine, the new conditions will come into force on March 1, 2023 and relate to the receipt of documents, payment for collective housing. Polish legislators have decided to regulate the issue of assistance to citizens of Ukraine.

Meanwhile, financial assistance to Ukrainians in Germany is being increased.
