The Russian court went to meet the Tsargrad TV channel, which filed a lawsuit against Google due to the blocking of the YouTube channel. Now the American company is obliged to unblock Constantinople or pay a large penalty every day.
The decision of the Moscow Arbitration Court was reported to Vedomosti with reference to the law firm Art de Lex, which represents the interests of the owner of the TV channel, Konstantin Malofeev. At the time of publication, this decision was not displayed in the case card.
Constantinople's claims were related to the blocking on YouTube in July 2020. The TV channel was banned “without the possibility of recovery” due to violations of “laws on sanctions and trade rules.” The reason was the owner and founder of the TV channel, Orthodox businessman Konstantin Malofeev, who has been under US sanctions since 2014 due to suspicions of aiding the armed formations in Donbass.
The publication notes that the court for the first time applied the rule on the priority of national law over international law in a dispute with foreign companies on the issue of sanctions. The judge ruled to grant the claim against Google in full. He demanded to restore the account of “Constantinople” and invalidate Google's unilateral refusal to monetize the posted content.
Thus, the American Internet giant still remains and owes money for monetizing the content of the YouTube channel. If Google does not unban the Tsargrad account, then after the verdict comes into force, the company will be charged an additional 100,000 rubles every day. Representatives of the company have not yet commented on the court's decision.
The TV channel “Tsargrad” began broadcasting in 2015. According to its founder, Konstantin Malofeev, he conceived his TV channel as “the tribune and the voice of the Orthodox majority.” The channel has repeatedly compiled a “list of Russophobes of the year” and offered to pay “sodomy and perverts” a ticket abroad. In 2020, Malofeev's associates turned to the FSB with a request to “deal with” Bill Gates and the coronavirus.
