The Dutch Supreme Court upheld part of the Russian appeal in a $ 50 billion arbitration against former shareholders of the Yukos oil company.
The court announced its decision on Friday, November 5, “Evropeyskaya Pravda” writes.
“The Supreme Court ruled in favor of the Russian Federation on one point. It considers that, for procedural reasons, the Court of Appeal in The Hague erroneously ignored the argument of the Russian Federation that the shareholders probably committed fraud in the arbitration procedure. Therefore, the decisions of the Court of Appeal cannot remain valid, “the message says.
At the same time, the Supreme Court of the Netherlands dismissed other complaints of the Russian Federation. This concerns, in particular, the complaints of the Russian Federation on the interpretation of the provisions of the agreement, on which the arbitration court substantiated its jurisdiction, and complaints that the arbitration court did not fulfill its mandate.
The Supreme Court sent the case to the Amsterdam Court of Appeal to consider and assess this issue.
