“Gray” passport: how Ukrainians abroad bypass restrictions on the provision of consular services

In some European countries, Ukrainians can obtain a so-called foreigner’s passport, which allows them to temporarily not issue Ukrainian identity documents.

Trying to return draft dodgers to their homeland, the authorities limited the rights of Ukrainians liable for military service who fled from mobilization abroad. In particular, after the mobilization law No. 10449 comes into force in May 2024, men without military registration documents will not be able to obtain new documents from diplomatic institutions of Ukraine. Changes in legislation have forced Ukrainians abroad to look for alternative ways to obtain valid documents, in particular, a “gray” passport, which can be obtained by foreigners and stateless persons in different countries.

A “grey” foreigner’s passport allows you to legally stay in the country, and also provides a number of rights that differ depending on the country that issued the document. Typically, a “gray” passport is issued for a period of one to five years, after which the document must be renewed.

Several countries issue such documents to Ukrainians:

In Poland, a temporary TZTC certificate is issued by the Border Guard to those foreigners who have applied for international protection. It allows you to legally stay in the country.

In Germany, the so-called “alien travel document” is issued to those who already have refugee status, but obtaining this “grey” passport is quite difficult. It allows you not only to stay in Germany, but also to travel to other EU countries without a visa.

In Latvia and Estonia you can get a special document – a “non-citizen passport”. It also allows you to travel to Schengen countries, and in Estonia, its owner can even vote in municipal elections and apply for citizenship if he successfully passes an exam on knowledge of the language, history and constitution of the country.

A foreigner’s passport can also be obtained in Finland. It is issued to everyone who has received a residence permit in the country as a person in need of protection, but this document does not give the right to travel outside Finland.

Recall that the people’s deputy “smashed” the ban on consular services for men. Irina Friz recalled that the law on mobilization does not provide for measures to ban all consular services.
