During mobilization for military service, draft evasion is punishable by imprisonment for a term of three to five years. During the war, out of 66 verdicts, there was not a single acquittal.
According to data from the Unified State Register of Court Decisions, in most cases, courts for draft evasion impose a sentence of imprisonment for a term of three year and with a trial period of one year. Lawyer Roman Likhachev spoke about this.
How severely the Ukhilians are punished
At the same time, only once the court imposed a sentence of five years in prison with a probationary period of three years. As noted by the volunteer movement “Lawyers of the Armed Forces of Ukraine”, the difference between the situation and previous sentences for imposing such a severe sentence is not clear.
Number of sentences by region:
- < li> Volyn region – 5 sentences (1 against an internally displaced person);
- Dnipropetrovsk region – 7 sentences (1 against an internally displaced person);
- Zhytomyr region – 1 sentence;
- Zakarpattia region – 31 sentences (9 against internally displaced persons);
- Ivano-Frankivsk region – 2 sentences (1 against internally displaced persons);< /li>
- Kirovohrad region – 2 sentences;
- Lviv region – 10 sentences (2 sentences against internally displaced persons);
- Poltava region – 1 sentence;
- Rivne region – 1 sentence;
- Sumy region – 1 sentence;
- Kharkiv region – 2 sentences (2 against internally displaced persons);
- Cherkasy region – 2 sentences;
- Chernivtsi region – 1 sentence.
The leader in terms of the number of sentences passed was the Mukachevo City District Court of the Transcarpathian region – 19 sentences, 18 of which were on probation.
As noted in the volunteer movement, in the courts of the Transcarpathian region, the defendants quite often received a sentence of four or five years in prison in the event of the approval of plea agreements with prosecutors, that is, more than in cases of non-conclusion of plea agreements.

- Roman Likhachev from the volunteer movement “Lawyers of the Armed Forces of Ukraine” also explained that those convicted of evasion are not removed from military records – violators are subject to mobilization after being held accountable.
- Lawyer Polina Marchenko also spoke about the consequences for not appearing at the military registration and enlistment office after receiving the summons and explained which summons is considered to be delivered incorrectly. Yes, subpoenas can be served in public places, but filling them out directly at the time of delivery is the same as forging documents.
- In July, the Verkhovna Rada supported in the first reading a draft law exempting people whose relatives from mobilization died in the war started by Russia. At the same time, we are talking not only about the full-scale invasion of Russia on February 24, 2022. And also about the war of Russia against Ukraine since 2014.
