The State Intellectual Property Office of the People's Republic of China (CNIPA) has prevented Apple from banning Huawei from using the MatePod trademark. Earlier, the American company said that the name is similar to one of those that belong to it.
Apple worried about its brands: iPod, EarPods and AirPods. The Cupertino-based company argued that Huawei “maliciously copied” the trademark, and that it could have a negative impact on society.
These arguments were not convinced by CNIPA, which ruled in Huawei's favor. The regulator added that there is “not enough evidence” to confirm that Huawei copied something. CNIPA recognized the similarities between companies in terms of “functionality, sales channel and target customers.” However, “the spelling of trademarks is different,” so their existence will not cause confusion among consumers.
